Asbestos the Hidden Killer?

asbestos exposure compensation claim

Asbestos comprises minute mineral silicate fibres. These can't be broken down or removed by the body and are highly irritant. Asbestos fibres cause scarring to the tissue linings of the lung, making gaseous exchange and breathing difficult. Prolonged high level exposure to asbestos may lead to Asbestosis, benign or diffuse Pleural Thickening and Asbestos induced lung cancer, also known as Mesothelioma.

Asbestos Exposure - can I claim and who does it affect?

You cannot claim personal injury compensation for Asbestos Exposure alone, asbestos diseases take many years to rear their ugly heads and usually require high or prolonged exposure. If you have been exposed to asbestos tell your employer and if appropriate the Health and Safety Executive or your Local Authority. Unfortunately cannot help if you do not have any symptoms / have been diagnosed with an asbestos related disease.

You cannot claim for Pleural Plaques due to Asbestos in England or Wales, if you are a Scottish resident then you may be able to claim.

Asbestos related diseases such as Asbestosis and Mesothelioma tend to occur in people who have worked extensively with asbestos, and where exposure to the asbestos fibres was high, for example asbestos removal, demolition or boiler repair.

What is Asbestosis?

Asbestosis is a chronic respiratory disease which can take several years to develop following initial Asbestos exposure. (However this can be much accelerated in heavy smokers). A history of continuous high level exposure to Asbestos is usual in the development of Asbestosis.

Asbestosis is characterised by scarring (called fibrosis) of the lung tissue and is due to the direct irritation by the Asbestos fibres. Asbestosis is incurable but treatment is available to relieve symptoms.

Asbestosis Cases

The graph below shows a clear increase in the number of Asbestosis cases in the UK since 2003, this trend is expected to continue for the foreseeable future (Health & Safety Executive).

What is Mesothelioma?

Mesothelioma is a malignant cancer of the Mesothelium (the mesothelium covers the outer surface of most of our internal organs). Most malignant mesothelioma cases occur in the tissues covering the Lungs (pleura) and Abdomen. Mesothelioma is a rare tumor and is highly associated with Asbestos exposure. However benign Mesothelioma is not associated with Asbestos.

Exposure to Asbestos is the only known cause of Malignant Mesothelioma and symptoms may not appear for many years (20-50 years) after the initial Asbestos exposure.

A link between Asbestos exposure and Mesothelioma has been known since the early 18th Century. Almost as many as 8 out of 10 people diagnosed with Mesothelioma report exposure to Asbestos.

Mesothelioma Deaths 2012

The pie chart below shows that there were over 2500 deaths attributable to Mesothelioma in England, Scotland & Wales in 2012 (Health & Safety Executive).

The first step if you are suffering from any Asbestos related disease (Asbestosis or Mesothelioma) would be to contact RSR Law and we will assess your claim for compensation and advise you on whether you will be eligible to claim.

It is vital to establish a relationship between your symptoms and exposure to asbestos.  If you have not done so already the second step will be to see your doctor who will be able to establish a link to asbestos.
